The standard operating procedure in Georgia workers’ comp cases is: Delay, Deny, Defend. In Georgia workers’ compensation cases, the injured worker is often blamed by his employer for having an accident and making insurance rates rise, even though workman’s comp is not a fault-based system. The employer and adjuster often insinuate the injured worker is lying about the accident or injury. The employer/adjuster then sends the employee to company doctors who act as if they do not believe the person’s pain is real and who often delay diagnostic testing for months.
